Retail clients in Australia are entitled to enhanced protections, including access to a Product Disclosure Statement (PDS), a Target Market Determination (TMD), and robust internal dispute resolution processes.<\/p>\n\n\n\n<p>ASIC Deputy Chair Sarah Court criticized Binance\u2019s compliance systems, calling them \u201cwoefully inadequate.\u201d Court also noted that numerous clients suffered substantial financial losses due to insufficient legal protections.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-key-allegations-of-regulatory-breaches\">Key Allegations of Regulatory Breaches<\/h3>\n\n\n\n<p>ASIC\u2019s legal action outlines several alleged violations by Binance, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Failure to Provide Legal Documentation:<\/strong> Binance did not issue required documents like the PDS or TMD to retail clients.<\/li>\n\n\n\n<li><strong>Inadequate Dispute Resolution:<\/strong> The company lacked effective internal mechanisms to address customer complaints.<\/li>\n\n\n\n<li><strong>Compliance Failures:<\/strong> Employees were reportedly not trained to meet the requirements of Binance\u2019s financial services license.<\/li>\n\n\n\n<li><strong>Inefficient Practices:<\/strong> Binance allegedly failed to deliver its services \u201cefficiently, honestly, and fairly.\u201d<\/li>\n<\/ul>\n\n\n\n<p>In April 2023, ASIC canceled Binance\u2019s Australian financial services license after conducting a review of its operations.
