The move signals the government\u2019s willingness to revisit existing tax rules that many argue are stifling market growth.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-key-issues-under-review\">Key Issues Under Review<\/h3>\n\n\n\n<p>The consultation is exploring several major points:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Should the current tax framework continue, or is a separate crypto law required?<\/li>\n\n\n\n<li>Which regulatory body should oversee a dedicated statute?<\/li>\n\n\n\n<li>Is the 1% Tax Deducted at Source (TDS) on every transaction too high, and if so, what would be a fairer rate?<\/li>\n\n\n\n<li>Should traders be allowed to offset losses from crypto investments?<\/li>\n\n\n\n<li>Are rigid rules forcing investors and businesses to shift operations abroad?<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-current-tax-rules-on-crypto\">Current Tax Rules on Crypto<\/h3>\n\n\n\n<p>Since April 2022, India has imposed strict tax measures on VDAs:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A flat 30% tax applies to all crypto gains, with no benefits from capital gains rules. Only acquisition costs are deductible.<\/li>\n\n\n\n<li>From July 2022, Section 194S introduced a 1% TDS on every VDA transfer above specified limits, collected at the time of transaction.<\/li>\n\n\n\n<li>Losses from crypto cannot be set off against other gains or carried forward to future years.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-impact-on-the-industry\">Impact on the Industry<\/h3>\n\n\n\n<p>Industry participants say these rules have made local trading unviable:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trading volumes on Indian exchanges reportedly plunged by as much as 90% after the TDS was enforced.<\/li>\n\n\n\n<li>Advisory groups such as Chase India and IndusLaw have urged lowering the TDS to 0.1\u20130.5% and allowing loss carry-forward to improve compliance while still tracking transactions.<\/li>\n\n\n\n<li>The tax department has stepped up scrutiny, targeting high-risk individuals suspected of evasion and carefully examining income-tax filings.<\/li>\n\n\n\n<li>Despite challenges, tax collections from crypto increased to \u20b9437.43 crore in FY 2023-24, up from \u20b9269.09 crore the previous year.<\/li>\n<\/ul>\n\n\n\n<p>The CBDT\u2019s consultation on a dedicated VDA code could reshape India\u2019s crypto tax landscape. A more balanced approach\u2014such as reducing TDS and allowing loss adjustments\u2014may encourage compliance, prevent capital flight, and support domestic innovation.
