This decision came after an Australian judge criticized the Australian Securities and Investment Commission (ASIC) for publishing a misleading press release about the legal proceedings.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Legal Dispute and Court Ruling<\/h2>\n\n\n\n<p>ASIC sued Block Earner in 2022, claiming that two of its products, Earner and Access, required financial services licenses. While the court ruled in February that the Earner product was unlicensed, it determined that the DeFi \u201cAccess\u201d service did not need a license and could continue to operate.<\/p>\n\n\n\n<p>Despite this, ASIC issued a press release titled \u201cCourt finds Block Earner crypto product needs financial services licence,\u201d which Judge Ian McNeil Jackman deemed \u201cunfair and misleading.\u201d He upheld Block Earner\u2019s claim that the release misrepresented the court\u2019s findings. Consequently, ASIC was ordered to pay some of Block Earner\u2019s legal costs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Honest Engagement with Regulators<\/h2>\n\n\n\n<p>Judge Jackman also found that Block Earner should not be penalized for its Earner product because the company had acted in good faith by seeking to engage with regulatory authorities. This engagement demonstrated Block Earner\u2019s commitment to navigating the complex regulatory landscape of crypto-related products and services.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Industry Reactions<\/h2>\n\n\n\n<p>Michael Bacina, Chair of Blockchain Australia, supported the court\u2019s decision, emphasizing the importance of legal advice in the evolving crypto sector. \u201cThe court rightly calls out \u2018a deeper issue\u2019 that the \u2018rules of the legal system are promulgated and clear,\u2019\u201d Bacina said.
