DOJ Recommends 3-Year Sentence for Binance Founder Changpeng Zhao

Changpeng “CZ” Zhao, the founder and former CEO of Binance, the world’s largest cryptocurrency exchange, is facing a potential three-year prison sentence as recommended by the U.S. Department of Justice (DOJ). This sentencing recommendation comes after Zhao’s guilty plea last November to charges of violating the Bank Secrecy Act, highlighting significant breaches in regulatory compliance by Binance.

Details of the DOJ’s Sentencing Recommendation

The DOJ filed a sentencing memo on Tuesday arguing for Zhao to serve 36 months in prison along with a substantial $50 million fine. This recommendation exceeds the initial terms of Zhao’s plea agreement, which suggested up to 18 months of imprisonment. The DOJ justifies the harsher sentence by citing the extensive impact and the serious nature of Zhao’s misconduct, emphasizing the need for a sentence that serves both punitive and deterrent purposes.

The Scale of Misconduct

According to the DOJ, Zhao’s failure to implement an effective anti-money laundering (AML) program at Binance allowed the platform to become a conduit for illicit activities. These included operations involving mixing services that obscured the origins of cryptocurrency, transactions tied to ransomware attacks, and the movement of funds from darknet market transactions, among others. The DOJ’s filing highlighted these activities to underscore the gravity of Zhao’s violations and the resultant threat to U.S. national security.

The case against Zhao and Binance has broader implications for the cryptocurrency industry, especially concerning the adherence to U.S. laws and regulations. The filing criticized the current Sentencing Guidelines for Bank Secrecy Act violations as inadequate for addressing misconduct at this scale or that jeopardizes U.S. national security.

In addition to Zhao’s sentencing, Binance itself has admitted to related charges and agreed to a $4.3 billion fine while committing to oversight by a court-appointed monitor, whose appointment is still pending.

Zhao, who has been unable to return to Dubai where his family resides, is scheduled for sentencing on April 30, following a postponement from the original February date. The delay was mutually agreed upon by both parties involved in the case. Zhao has also waived his right to appeal any sentence that is 18 months or shorter, as part of his plea deal.
