DOJ Reviews Binance’s $4.3 Billion Settlement Amid Iran Sanctions Probe
The U.S. Department of Justice (DOJ) is examining whether Binance violated the terms of its $4.3 billion settlement with U.S. authorities in 2023, as federal prosecutors investigate potential sanctions violations involving Iran. Bloomberg reported the latest development on October 9, adding fresh scrutiny to the world’s largest cryptocurrency exchange.
The review raises questions about Binance’s compliance with the agreement, which required the company to strengthen its internal controls and cooperate with U.S. authorities. However, officials have not concluded that Binance breached the settlement, and the investigation could end without additional charges.
DOJ Scrutinizes Binance’s Compliance Obligations
Tysen Duva, head of the DOJ’s criminal division, confirmed that officials were reviewing Binance’s compliance with its 2023 agreement. He declined to discuss specific evidence or the investigation’s progress.
Under the settlement, Binance pleaded guilty to federal offenses involving banking regulations, money transmission and sanctions compliance. The company agreed to pay approximately $4.3 billion in penalties and implement enhanced compliance measures.
The agreement also requires Binance to report evidence or allegations of misconduct involving money laundering, banking transactions and sanctions violations to the U.S. government.
If authorities establish a material breach, Binance could face renewed prosecution related to conduct addressed by the original settlement. Additional financial penalties could also follow, potentially exposing the company to billions of dollars in further costs.
Iran-Linked Transactions Draw Fresh Scrutiny
The settlement review comes as federal prosecutors investigate whether Binance allowed transactions that violated U.S. sanctions against Iran. The Manhattan U.S. attorney’s office is leading the investigation, with support from the DOJ’s criminal division in Washington.
In September, prosecutors sought the forfeiture of $61 million that they alleged originated from Iranian black-market oil sales and was laundered through cryptocurrency transactions involving Binance. That action did not establish that Binance itself committed wrongdoing in connection with the funds.
Binance has maintained that it takes sanctions compliance seriously and continues to cooperate with law enforcement. The company also says it is strengthening its controls and addressing illicit activity on its platform.
Compliance Risks Could Have Financial Consequences
The investigation highlights the continuing regulatory risks facing major cryptocurrency exchanges, particularly those operating across international markets. Even after a substantial settlement, companies must demonstrate that their compliance systems meet the obligations imposed by regulators.
For Binance, the outcome could affect its legal exposure and reputation with institutional clients and regulators. However, the DOJ has not announced new charges against the exchange in connection with the latest investigation.
